This category presents an authentic hadith (no. 6081) that defines the scope of preemption: "The Prophet (may Allah's peace and blessings be upon him) decreed for partners the right of preemption in property which had not been divided up. However, if the boundaries are demarcated, and the roads are fixed, then there will be no right of preemption". Preemption thus appears as a right granted to the co-owner over undivided property, which ends as soon as the property is separated and demarcated.
